Supreme Court Weighs John Eastman Appeal of California Disbarment

The Supreme Court is considering whether to hear an appeal from attorney John Eastman challenging his disbarment by the California State Bar over his role in post-2020 election legal strategies. Eastman's petition frames the disbarment as an attack on attorney free speech and part of a broader pattern of politically motivated bar disciplinary proceedings against lawyers who represented Trump.

Disbarment Timeline and Charges

The California Supreme Court disbarred Eastman in April 2026, finalizing a process that began with State Bar Court findings in March 2024. The State Bar Court Review Department affirmed the recommendation in July 2025, finding Eastman culpable of 10 out of 11 charges for what it characterized as egregious and deceitful conduct. State Bar Court Judge Yvette Roland wrote in her 128-page ruling that Eastman's inaccurate assertions were lies that cannot be justified as zealous advocacy.

The charges centered on Eastman's legal advice regarding Vice President Mike Pence's role in certifying the 2020 electoral vote. Bar prosecutors argued Eastman knowingly advanced legally unsound theories about Pence's constitutional authority to reject electoral votes from disputed states. The January 6 congressional committee recommended federal criminal charges against Eastman, though no charges have been filed.

Free Speech Defense

Eastman's Supreme Court petition argues that attorney discipline for legal advice and courtroom advocacy threatens core First Amendment principles. The appeal contends that lawyers must be able to argue novel legal theories without fear of professional sanctions, even when those theories are ultimately rejected by courts. His legal team characterizes the California bar proceedings as retaliation for politically unpopular advocacy rather than enforcement of genuine ethical violations.

Chapman University, where Eastman previously taught constitutional law, distanced itself from him after January 6. The professor eventually resigned under pressure from the university community. His children have made public appeals for financial support to fund his legal defense costs, which have run into hundreds of thousands of dollars across multiple proceedings.

Professional Consequences

Eastman's disbarment represents one of the most significant professional consequences faced by any attorney who worked on Trump's post-election legal efforts. Several other lawyers involved in the challenges have faced or are facing disciplinary proceedings in their respective states. Rudy Giuliani was disbarred in New York and suspended in Washington DC for making false statements about election fraud.

The Supreme Court has not yet decided whether to grant certiorari in Eastman's case. If the justices decline to hear the appeal, the California disbarment becomes final with no further recourse. If they agree to take the case, it would put questions about attorney discipline, political speech, and professional ethics before the Court during a term already packed with contentious cases. Legal experts expect a decision on whether to grant review within the next several months.
